You have engaged University Shipping & Storage, LLC 7, a North Carolina limited liability company (the "Company"), to move your personal property to or from the Duke University Campus in Durham, North Carolina. By engaging the Company to provide these moving services to you, you agree to the following terms and conditions:

1. None of the property you have requested that we move on your behalf contains illegal drugs or narcotics, firearms, stolen materials or hazardous wastes.

2. You agree that we may open any containers that you ask us to move to make sure that all of the property included in your move is safe and lawful and complies with your promises in paragraph 1 above.

3. You will defend, indemnify and hold the Company, and its members, officers and agents harmless from any claim, demand, judgment, complaint or enforcement action that may arise out of or relate to the property you have asked us to move on your behalf.

4. You will inspect the property you ask us to move before it is loaded, and will call to our attention any concerns you may have about protection of the property during the move. If the property is particularly fragile, for example, you agree to notify us of that condition before the move begins so that appropriate steps can be taken to protect it against damage. If you do not bring such concerns to our attention, we cannot be responsible for any damage that occurs during the move.

5. You also agree to inspect the property when it is delivered to you so that any concerns that you may have about the condition of the property are identified so that we may respond immediately to your concerns. Any issues relating to condition that are not brought to our attention at the time we deliver the goods to you will be deemed to be waived and not our responsibility. The limit of our liability to you for any damage caused to your property during the course of the move is the amount that you pay us to make the move on your behalf. In no case is the Company responsible for any damages beyond the moving fee, and you hereby waive any such damages against the Company, its members, officers and agents.
